Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the Tenon website (tenon.fyi), the Tenon application, and related services (together, "Tenon"), provided by SmoothGrain Studios LLC, an Oregon limited liability company ("SmoothGrain", "we", "us", "our"). By downloading, installing, or using Tenon, or by purchasing a subscription, you agree to these Terms. If you do not agree, do not use Tenon.

1. The software and your license

Tenon is a Windows utility that makes Apple input devices work fully on Windows. Subject to these Terms and your active plan, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use Tenon on devices you own or control. Tenon offers a free tier and a paid "Pro" tier; some features require an active Pro subscription or trial.

You agree not to:

• copy, resell, sublicense, rent, or redistribute Tenon;
• reverse engineer, decompile, or disassemble the software, except to the extent that restriction is prohibited by applicable law;
• circumvent licensing, entitlement, or activation mechanisms; or
• use Tenon unlawfully or in violation of these Terms.

2. Accounts

Some features require a SmoothGrain account. You are responsible for activity under your account and for keeping your sign-in credentials secure. Your Pro entitlement is tied to your account, not to a specific device.

3. Subscriptions, trials, and billing

Tenon Pro is offered as an auto-renewing subscription. Unless you cancel, your subscription renews automatically at the end of each billing period and the payment method on file is charged the then-current price for that period. We offer an annual plan and may offer a multi-year (for example, two-year) prepaid term. Tenon’s 30-day free trial runs inside the app and does not require an account, a card, or a purchase — nothing is charged during it and there is nothing to cancel. Subscribing is a separate step, and the first charge is taken at checkout.

You can cancel at any time; your Pro access continues until the end of the current paid period, and you will not be charged again after cancellation. Prices may change, and we will give reasonable advance notice before a change applies to your next renewal. See our Refund and Cancellation Policy for refunds and how to cancel.

4. Payments and merchant of record

Our order process and payments are handled by our merchant of record, Paddle.com Market Limited and its affiliates ("Paddle"). When you buy Tenon Pro, Paddle is the seller and merchant of record for that transaction: Paddle processes your payment, handles billing and invoicing, and collects and remits applicable sales tax and VAT. Your purchase is therefore also subject to Paddle's Buyer Terms. SmoothGrain does not receive or store your full payment-card details.

5. Refunds

We offer a money-back guarantee described in our Refund and Cancellation Policy. Approved refunds are processed through Paddle to your original payment method.

6. Intellectual property

Tenon, including its software, design, branding, and content, is owned by SmoothGrain and its licensors and is protected by intellectual-property laws. These Terms grant you a license to use Tenon; they do not transfer ownership to you. "Tenon" and "SmoothGrain" are our marks. Apple, Magic Mouse, Magic Trackpad, Magic Keyboard, and AirPods are trademarks of Apple Inc.; SmoothGrain is not affiliated with, endorsed by, or sponsored by Apple Inc.

7. Beta program

From time to time we invite people to test pre-release builds of Tenon. If you take part, this section applies to you in addition to the rest of these Terms, and it prevails over them for anything to do with beta builds.

Pre-release software. Beta builds are unfinished. They are not feature complete, they have not completed our own validation, and they may contain defects that a released version would not. Tenon works by installing kernel-mode drivers, so a defect in a beta build can do more than misbehave: it can make an input device stop responding, prevent a device from pairing, or make Windows itself unstable, including a stop error ("blue screen"). Features present in a beta build may change or be removed before release, and we may end the beta, withdraw a build, or stop supporting it at any time.

You install at your own risk. You choose whether to install a beta build, and you do so on hardware you own or control. Before installing, make sure you can still operate the machine if your Apple device stops working — keep a second mouse or keyboard to hand — and make sure your data is backed up. We recommend you do not install a beta build on a machine you depend on for work. To the maximum extent permitted by law, you assume the risk of installing and running pre-release software, and the disclaimers and liability limit in sections 8 and 9 apply in full.

No warranty and no service levels. Beta builds are provided free of charge, "as is" and "as available", with no warranty of any kind. Nothing we publish about support response times applies to beta builds, and the money-back guarantee in our Refund and Cancellation Policy does not apply to them, because nothing has been paid. Beta builds are licensed to you for your own testing only; do not redistribute, resell, or publish them.

Feedback and diagnostics. If you send us feedback, bug reports, survey answers, suggestions, or a diagnostics bundle, you grant SmoothGrain a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, and incorporate that material into Tenon and our other products and documentation, with no obligation to compensate you and no obligation to act on it. You keep ownership of what you send. Please do not send us anything confidential or anything you are not free to share; we treat what you send as non-confidential apart from your personal information, which is handled under our Privacy Policy. What a diagnostics bundle contains is itemised in Privacy Policy section 3. Nothing here obliges you to keep the beta secret — you are free to write and talk publicly about your experience with it.

Leaving the beta. You can stop at any time and you do not have to tell us why. Run uninstall-tenon.ps1 from the beta package in an elevated PowerShell window; it removes the Tenon drivers, the app, and the AirPods watcher, and returns your Apple devices to the drivers built into Windows. To have your beta application and any diagnostics you sent us deleted, email [email protected] and we will delete them.

8. Disclaimers

Tenon is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Tenon will be uninterrupted, error-free, or compatible with every device or future operating-system update.

9. Limitation of liability

To the maximum extent permitted by law, SmoothGrain will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising out of or relating to your use of Tenon. To the maximum extent permitted by law, our total liability for any claim relating to Tenon will not exceed the amount you paid for Tenon in the twelve months before the event giving rise to the claim.

10. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above, and material changes take effect on posting (or as otherwise required by law). Your continued use of Tenon after changes take effect constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the State of Oregon, USA, without regard to its conflict-of-laws rules. Nothing in these Terms limits any non-waivable statutory rights you may have as a consumer in your country of residence.
